1. About this policy
1.1. Artlandish Pty Ltd (ABN: 88 135 783 765, ACN: 135 783 765) (“Artlandish”, “we”, “us” or “our”) respects your right to privacy and is committed to protecting the personal information of our customers and website visitors. We are bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth) and we handle personal information in accordance with that Act. This policy explains how we collect, use, disclose, store and protect your personal information, and how you can access it, correct it or make a complaint.
1.2. This policy applies to our websites www.aboriginal-art-australia.com and www.aboriginalartshop.com and to our dealings with you in person, by phone, by email and through our online stores.
1.3. “Personal information” means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not it is true and whether or not it is recorded in a material form.
2. What personal information we collect
2.1. The personal information we collect depends on how you interact with us. It may include:
- your name, email address, postal address, billing and shipping address, and phone number;
- order and transaction details, and records of your communications with us;
- payment information, which is processed by our payment providers (we do not store full card numbers on our own systems);
- feedback, survey responses, reviews and your contact or marketing preferences; and
- information collected automatically when you use our website, including your IP address, device and browser type, operating system, the page that referred you, the pages and products you view, and how you interact with the site (we refer to this as technical and usage information).
2.2. We use cookies, tracking pixels and similar technologies, including the Meta (Facebook) pixel and Google advertising and analytics tags, to collect technical and usage information and to deliver and measure advertising. Where this information is used to identify, single out or target you as an individual, we treat it as personal information and handle it under this policy. See section 5 for detail and for how to opt out.
2.3. We generally do not collect sensitive information (such as information about your health, race, religion or political views). If we ever need to collect sensitive information, we will only do so with your consent or where the law otherwise permits, and we will not use sensitive information for direct marketing without your consent.
3. How we collect your personal information
3.1. We collect personal information directly from you when you place an order, create an account, contact us, subscribe to our communications, leave a review, or otherwise interact with us electronically or in person.
3.2. We also collect technical and usage information automatically through cookies and similar technologies when you visit our websites.
3.3. We may receive personal information about you from third parties, such as our payment, shipping, analytics and advertising providers. Where we do, we handle that information in accordance with this policy.
4. Why we use your personal information
4.1. We use personal information to:
- process and fulfil your orders, including payment, shipping, invoicing and order confirmations;
- provide our products and services and respond to your enquiries and support requests;
- screen orders for fraud or other risk;
- improve our products, services and websites, and understand how customers use our site;
- send you updates and, where permitted, marketing about our products, services and offers (see section 6); and
- comply with our legal obligations and protect our legal rights.
5. Cookies, tracking technologies and online advertising
5.1. Cookies are small files placed on your device that help a website recognise you and remember details about your use of the site. We use cookies and similar technologies to operate the site, to analyse traffic, and to deliver and measure advertising. Most browsers accept cookies automatically, but you can change your browser settings to refuse cookies. If you do, some parts of our site may not work properly.
5.2. We advertise across major online platforms, including Google and Meta (Facebook and Instagram), and we use their pixels and tags to show relevant ads to people who have visited our site and to measure how our advertising performs. This means you may see our ads on other websites and platforms after visiting our site. Opting out does not reduce the number of ads you see; it makes the ads you see less likely to be based on your activity on our site.

5.4. You can opt out of Google Analytics using the browser add-on at https://tools.google.com/dlpage/gaoptout.
5.5. Some browsers send a “Do Not Track” or similar signal. There is currently no consistent industry standard for responding to these signals, and our site does not respond to them differently. You can still control advertising and analytics using the options above.
6. Direct marketing and your choices
6.1. We will only send you commercial electronic messages, such as marketing emails or SMS, where you have consented to receive them or where it is otherwise permitted under the Spam Act 2003 (Cth). Every marketing message identifies us as the sender and includes a working unsubscribe option.
6.2. You can opt out of marketing at any time by using the unsubscribe link in any message, by adjusting your account or contact preferences, or by contacting us using the details in section 14. We will action your request promptly and in any event within the timeframe required by law. Opting out of marketing does not stop service messages that we need to send you about your orders or account.
6.3. If you ask us not to use your personal information for direct marketing, we will comply, and on request we will tell you where we obtained your information.
7. Disclosure of your personal information
7.1. We may disclose your personal information to:
- our employees, officers, contractors and professional advisers, where reasonably necessary for the purposes in this policy;
- service providers who perform functions on our behalf, such as payment processing, shipping and logistics, IT and hosting, email and CRM, analytics, and advertising platforms (including Google and Meta), and only as needed to provide those services;
- a purchaser or potential purchaser in connection with a sale or transfer of our business or assets, subject to appropriate confidentiality protections; and
- a person or authority where we are required or authorised by law to do so, including to comply with a law, court order, subpoena or warrant, in legal proceedings, or in response to a lawful request from a law enforcement or government agency.
7.2. We may also use or disclose personal information to protect the copyright, trademarks, other legal rights, property or safety of Artlandish, our customers or third parties.
7.3. We only use Google’s approved API or interface to upload customer information, such as email addresses, for use in advertising, and we require our service providers to handle personal information consistently with this policy and applicable law.
8. Disclosure of personal information overseas
8.1. Some of our service providers store or process personal information outside Australia, including in the United States and the United Kingdom, and in other countries where our providers operate. When we disclose personal information to an overseas recipient, we take reasonable steps to ensure it is handled consistently with this policy and the Australian Privacy Principles.
9. Security of your personal information
9.1. We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include both technical measures (such as encrypted connections, access controls and, where appropriate, multi-factor authentication) and organisational measures (such as staff awareness, data handling practices and incident response procedures).
9.2. No method of transmission or storage is completely secure. The transmission of information to and from us is at your own risk, and while we work to protect your information, we cannot guarantee absolute security.
10. Data breaches
10.1. If we suspect a data breach involving personal information, we will assess it promptly. Where a breach is likely to result in serious harm to affected individuals, and we are unable to prevent that likely harm through remedial action, we will notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) in accordance with the Notifiable Data Breaches scheme, and we will include recommendations about the steps you can take in response.
11. Retention of your personal information
11.1. We keep personal information only for as long as we need it for the purposes set out in this policy, including to fulfil orders, meet our legal, tax and accounting obligations, resolve disputes and enforce our agreements. When we no longer need it, we take reasonable steps to securely delete or de-identify it.
12. Accessing and correcting your personal information
12.1. You may request access to the personal information we hold about you, and you may ask us to correct it if you believe it is inaccurate, out of date, incomplete, irrelevant or misleading. Please contact us using the details in section 14. We will respond within a reasonable time.
12.2. We may refuse access or correction in the limited circumstances permitted by the Privacy Act. If we refuse, we will tell you why and how you can complain.
13. Automated decision-making
13.1. We do not use automated decision-making that produces decisions which could reasonably be expected to significantly affect your rights or interests without human involvement. If this changes, we will update this policy to describe the relevant systems and decisions, consistent with our obligations under the Privacy Act.
14. Children
14.1. Our websites and online stores are intended for adults and are not directed at children under 18. We do not knowingly collect personal information from children under 18. If you believe we have collected personal information from a child, please contact us and we will take reasonable steps to delete it.
15. Third party websites
15.1. Our site may contain links to websites we do not own or control. These links are provided for your convenience and do not imply our endorsement. We are not responsible for the privacy practices of those websites, and we encourage you to read their privacy policies.
16. Complaints
16.1. If you have a complaint about how we have handled your personal information, please contact us using the details in section 14 so that we can try to resolve it. We take complaints seriously and will respond as soon as practicable.

This section applies if you are located in the European Union or the United Kingdom and provides additional information required under the EU General Data Protection Regulation (GDPR) and the UK GDPR. It supplements, and should be read together with, the main policy above.
Personal information we collect
When you visit our site, we automatically collect information about your device, including your web browser, IP address, time zone, and cookies installed on your device. As you browse, we collect information about the pages and products you view, the websites or search terms that referred you, and how you interact with the site. We call this “Device Information,” and we collect it using cookies, log files, and pixels, tags and web beacons.
When you make or attempt to make a purchase, we collect your name, billing and shipping address, payment information, email address and phone number. We call this “Order Information.” In this section, “Personal Information” means both Device Information and Order Information.
How we use your Personal Information

We share Personal Information with service providers who help us operate our business, including Google (analytics and advertising) and Meta (advertising). We may also share Personal Information to comply with applicable laws, to respond to a lawful request, or to protect our rights.
Behavioural advertising
We use Personal Information to provide targeted advertising. You can opt out of targeted advertising using the links in section 5.3 of the main policy, and you can learn more about how targeted advertising works through the Network Advertising Initiative at https://www.networkadvertising.org/understanding-online-advertising/how-does-it-work.
Your rights
If you are an EU or UK resident, you have the right to access the Personal Information we hold about you and to ask that it be corrected, updated, restricted, ported to you or another provider, or deleted. You also have the right to object to certain processing and to withdraw consent at any time. To exercise these rights, contact us using the details in section 18 above. You also have the right to lodge a complaint with your local supervisory authority.
International transfers
Your Personal Information will be transferred outside the European Union and the United Kingdom, including to Australia and the United States. Where required, we put in place appropriate safeguards for such transfers, such as standard contractual clauses.
Data retention
When you place an order, we keep your Order Information for our records and to meet our legal obligations unless and until you ask us to delete it, subject to any retention we are required or permitted to maintain by law.
